Regarding the mandatory use of liquid biofuels (bio-components) in the transport sector

The Verkhovna Rada of Ukraine decrees:

I. To amend the following laws of Ukraine:

1. In the Law of Ukraine "On Alternative Fuels" (Bulletin of the Verkhovna Rada of Ukraine, 2000, No. 12, p. 94 with subsequent amendments):

    1. To revise Article 1 as follows:

Article 1. Definitions

In this Law, the terms are used in the following meanings:

    • alternative fuels - solid, liquid, and gaseous fuels that serve as alternatives to traditional fuels and are produced (extracted) from non-traditional sources and types of energy raw materials;
    • biobutanol - butyl alcohol made from biomass, used as biofuel or bio-component;
    • biohydrogen - hydrogen obtained from biomass and is one of the types of biogas;
    • biogas - gas obtained from biomass, used as fuel;
    • biodiesel (biodiesel fuel) - monoalkyl esters of higher fatty acids, derived from vegetable oils or animal fats, used as biofuel or bio-component;
    • bio-DME - dimethyl ether (DME) made from biomass, used as a component of motor fuel;
    • bio-ETAe - ethyl tertiary-amine ether (ETAe) made using bioethanol, used as a component of motor fuel;
    • bio-ETBE - ethyl tertiary-butyl ether (ETBE) made using bioethanol, used as a component of motor fuel;
    • bioethanol - anhydrous ethyl alcohol made from biomass or ethyl alcohol-raw obtained from biomass, used as biofuel or bio-component;
    • biocomponent - biofuel used as a component of other types of fuel;
    • biological fuels (biofuels) - solid, liquid, and gaseous fuels made from biologically renewable raw materials (biomass), which can be used as fuel or component of other types of fuel;
    • biomass - non-fossil biologically renewable organic matter, capable of biological decomposition, in the form of products, waste, and residues from forestry and agriculture (crop and livestock production), fisheries, and related industries, as well as part of industrial or municipal waste, capable of biological decomposition;
    • biomethane - biogas that meets the physical and chemical characteristics required for natural gas intended for transportation or distribution systems or for use as motor fuel;
    • biomethanol - methanol made from biomass, used as a component of motor fuel;
    • bio-MTBE - methyl tertiary-butyl ether (MTBE) made from biomethanol, used as a component of motor fuel;
    • biofuel producer - an economic entity that directly produces biofuel from biomass;
    • waste - slag and waste from industry, agriculture, municipal and other enterprises, which can be a source or raw material for the extraction or production of alternative fuels;
    • biomethane origin guarantee (including liquefied or compressed) - a document generated using the biomethane registry, confirming that biomethane is produced from biomass, and contains information, the list of which is defined by the Procedure for the operation of the biomethane registry;
    • hydrotreated vegetable oil - vegetable oil after thermo-chemical treatment with hydrogen;
    • bioethanol-based additives - bio-components of motor fuel obtained by synthesizing using bioethanol or mixing bioethanol with organic compounds and fuel derived from hydrocarbon raw materials, where the bioethanol content meets regulatory requirements and is classified as biofuel;
    • voluntary certification scheme - a system recognized by the European Commission for confirming the compliance of liquid biofuels (bio-components) and biogas, intended for use in the transport sector, with sustainability criteria through an independent audit;
    • sustainability criteria - requirements met by liquid biofuels (bio-components) and biogas intended for use in the transport sector, including indicators of reducing greenhouse gas emissions from using these types of biofuels and prohibiting the use of certain land areas for obtaining raw materials necessary for producing such biofuels;
    • independent audit - verification of the accuracy and reliability of the information and systems used by the economic entity to ensure compliance of liquid biofuels (bio-components) and biogas intended for use in the transport sector with sustainability criteria, conducted under a voluntary certification scheme recognized by the European Commission, in accordance with Ukrainian legislation;
    • non-traditional sources and types of energy raw materials - plant-derived raw materials, waste, solid combustible substances, other natural and artificial sources and types of energy raw materials, including exhausted, non-industrial, and technogenic deposits of oil, gas, gas condensate, oil-gas condensate, heavy oil grades, natural bitumens, gas-saturated waters, gas hydrates, etc., whose production (extraction) and processing require the application of advanced technologies and which are not used for producing (extracting) traditional types of fuel;
    • motor fuel - fuel for internal combustion engines of vehicles and equipment, including gasoline, diesel fuel, liquefied petroleum gas, compressed natural gas, biogas, biomethane, hydrogen, etc.;
    • biofuel supplier - an economic entity that supplies biofuel to other economic entities or sells biofuel on the market;
    • biomethane registry - an electronic system for tracking the origin guarantees of biomethane, which maintains records of the volumes of produced biomethane, guaranteed biomethane volumes, registered for production from biomass, volumes of biomethane supplied to transportation or distribution systems or used as motor fuel, and information on transferred biomethane origin guarantees;
    • component of industrial or household waste - biodegradable industrial or household waste suitable for extracting biogas or producing other types of biofuels;
    • solid biofuel - fuel made from biomass that can be used for generating thermal or electrical energy and as household fuel;
    • solid combustible substances - coal, combustible shale, peat, lignite, etc.;
    • traditional fuels - fossil fuel resources (natural gas, oil, coal, etc.) and fuel produced (extracted) from them;
    • circular economy - an economy based on resource-efficient production and consumption, involving the reuse of resources and minimizing waste;
    • greenhouse gas emission reduction scale - indicators of the reduction of greenhouse gas emissions resulting from the use of biofuels, expressed as a percentage, compared to greenhouse gas emissions from the use of fossil fuels.
